Official Contest Rules

Maille Ideas (“Contest”),

THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW.

ELIGIBILITY:

Contest is open to all legal residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry, except employees or agents (and those with whom they are domiciled) of the Sponsor, its advertising and promotion agencies and the contest judges.

HOW TO ENTER:

No purchase necessary. Contest begins on November 2, 2009 at 12:00:01 Eastern Time (ET) and ends on March 31st, 2010 at 11:59:59 ET (the “Contest Period”). To enter, go to www.mailleideas.ca (the “Web site”),click on the contest button located on the Home Page of mailleideas.ca then click on the “enter” button and an entry form will appear. Fully complete the entry form (which requires your first name, last name, e-mail address, postal code, age, and sex).

Limit of one (1) Entry per person/e-mail address during the Contest Period. If it is discovered that you attempted to enter more than once during the Contest Period, all your Entries will be void. Entries will be rejected if: (a) entry form is not fully completed (including Recipe/Picture when you submit a recipe) and submitted during the Contest Period; or (b) if the Recipe/Picture does not conform to the specific requirements listed below. Without limitation, Maille Canada (the “Sponsor”), its advertising and promotion agencies, and the contest judges are not responsible for late, lost, misdirected, delayed, incomplete, or incompatible Entries.

BONUS ENTRIES:

Each point collected corresponds to an additional Bonus Contest Entry. As indicated below, you can collect points by submitting a recipe (1), by sumitting photo of your recipe (2), by downloading your calendar (3), by completing the survey (4), by voting for a recipe (5) or by by sharing this site with one of your friends (6)

  1. You can earn ten (10) points by submitting one of your recipes. This recipe must contain a minimum of one (1) Maille product, no more than ten (10) ingredients (excluding spices), must clearly list the steps (maximum of ten (10)), and must be accompanied or not by a representative picture. This picture must illustrate the recipe submitted. Should you not submit a picture or should the picture submitted not be readable or simply unusable, Maille Canada shall provide a picture to go with your recipe. You will then be required to upload: one (1) picture (the “Picture”) and your recipe.
  2. Submit a photo of your recipe and earn ten (10) points. Your Picture (if submitted) must be in accordance with the specific requirements listed below and must depict, describe and/or discuss the recipe submitted. When you have finished completing all required fields (including uploading your Recipe and Picture), click the “Submit” button to complete your entry (entry form, Recipe and Picture referred to as “Entry/Entries”. Limit of one (1) photo for each recipe submitted.
  3. You can earn five (5) points by downloading one of the calendars available on the site [www.mailleideas.ca] by following the instructions provided on the web site. The calendar will be accessible from the web site's home page. For every unique monthly calendar that you download, you will be able to earn five (5) points, and therefore five (5) bonus Entries in the random draw. Limit of one (1) download per person/e-mail address per week during the Contest Period.
  4. You can earn five (5) points by completing the Maille survey on the site [www.mailleideas.ca] by following the instructions provided on the web site. When you have finished completing all required fields (fields will be determinated) click the “Submit” button to complete your survey. Limit of one (1) respond to the survey per person/e-mail address during the Contest Period.
  5. You can earn one (1) point by voting for one of the recipes on the site [www.mailleideas.ca] by following the instructions provided on the web site. You can click on the recipe of your choice and vote for it. Limit of one (1) vote per person/e-mail address per recipe during the Contest Period.
  6. Earn one (1) point every time you share the page [www.mailleideas.ca], one of your recipes or the calendar with a friend by following the instructions on the Contest Web page. Each valid e-mail address that you provide entitles you to one (1) additional entry in the Contest. Limit of five (5) entries by person/e-mail address per week during the Contest period.

By submitting a Recipe/Picture, the entrant agrees that the Recipe/Picture complies with all conditions stated in these Rules. The Sponsor and those associated with them will bear no legal liability, expressed or implied, regarding the use of the Recipe/Picture by the Sponsor and THE SPONSOR SHALL BE HELD HARMLESS BY AN ENTRANT IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE ENTRANT HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.

Recipe/Picture REQUIREMENTS:

Your submitted Recipe/Picture must never have been previously exhibited publicly or selected as a winner in any other contest. To be eligible for entry in the Contest, your Recipe/Picture must meet the following specific requirements:

Additionally, when creating your Recipe/Picture, you should keep the following in mind:

  • Be creative, innovative and engaging;
  • Be professional (e.g., ensure you have clear quality).

By participating in the Contest, each entrant agrees to be bound by these Official Rules (the “Rules”) and by the interpretation of these Rules by the Sponsor, and further warrants and represents that his/her Recipe/Picture:

  1. is original to him/her and that the entrant has all necessary rights in and to the Recipe/Picture and all of its components (if applicable) to enter the Recipe/Picture in the Contest. For example, you must have permission to use any and all Pictures and subjects.
  2. does not and will not violate any law, statute, ordinance or regulation;
  3. does not contain any reference to or likeness of any third parties, unless consent has been obtained from all such individuals (NOTE: if a Picture(s) contains any third parties who are under the age of majority in their province or territory of residence, then consent must also be obtained from any such persons parent or legal guardian);
  4. will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; and
  5. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following:
    • Nudity;
    • Explicit, graphic or excessive sexual activity;
    • Crude, vulgar or offensive language and/or symbols;
    • Derogatory characterizations of any ethnic, racial, sexual or religious groups;
    • Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct;
    • Personal information of individuals, including without limitation, names and addresses (physical or e-mail);
    • Conduct or other activities in violation of these Rules;
    • Commercial messages, comparisons or solicitations for products or services;
    • Any identifiable third party products and/or trademarks, brands or logos. For example, any clothing worn by persons appearing in a Picture must not contain any visible logos, trade-marks or other third party materials;
    • URLs or links to any Web sites; and
    • Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor and/or the contest judges in their sole discretion.

The Sponsor and/or the contest judges will initially screen every Recipe/Picture within 48 hours of that Recipe/Picture being submitted. Any Recipe/Picture that the Sponsor and/or the contest judges deem, in their sole discretion, to violate the terms and conditions set forth in these Rules will not be posted. Any Recipe/Picture that is deemed appropriate will be posted on the Web site and the entrant will receive an e-mail notification from the Sponsor indicating that the Recipe/Picture has been posted.

By entering the Contest and uploading a Recipe/Picture, each entrant: (i) grants to the Sponsor, in perpetuity, a nonexclusive licence to publish, display, reproduce, modify, edit or otherwise use the Recipe/Picture in whole or in part on the Web site and/or for advertising or promoting the Contest or for any other reason; and (ii) agrees to release and hold harmless the Sponsor and its advertising and promotion agencies, the contest judges and each of their respective agents, employees, directors, successors, and assigns against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property-related cause of action. For greater certainty, the Sponsor and/or the contest judges reserve the right, in their sole discretion, to modify, edit, or remove any Recipe/Picture, or to request an entrant to modify or edit his or her Recipe/Picture, if a complaint is received with respect to the Recipe/Picture, or for any other reason.

MONTHLY PRIZES:

There is one (1) monthly prize to be won each month for a total of five (5) prizes. Each prize to be won will consist of Actifry from T-fal with a value of CAD$ 400. The total value of the five (5) monthly prizes is CAD$ 2 000 .

The drawings will be held on: December 1, 2009; January 4 , 2010; February 1 , 2010 March 1, 2010, and April 1, 2010.

Grand PRIZE:

There is one (1) grand prize available to be won, consisting of one MAILLE® Feast, where the winner, along with nine (9) or less guests, will host a MAILLE® designated chef at his/her home. The MAILLE® Feast includes, one five (5)-course meal prepared by the MAILLE® designated chef, including alcoholic beverages. Total approximate prize value (APV): CAD$1 500. Winner's guests must have reached the legal drinking age in the province or territory of residence of the winner. The MAILLE® Feast must take place no later than April 1, 2011. Winner must inform MAILLE® Canada of the MAILLE® Feast date at least four (4) weeks prior to the MAILLE® Feast. MAILLE® Feast may not take place on December 24, 25, 26 or 31, 2010, nor on January 1 or 2, 2011. No substitution or transfer of prize by winner permitted. The APV of the grand prize is that stated by the supplier of the prize as being in effect thirty (30) days prior to the launching of this Contest.

All prizes must be accepted as awarded. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value. Maximum of one (1) monthly prize per person/e-mail address permitted during the Contest Period. All monthly prize winners remain eligible to win the grand prize (see below). Prizes will only be awarded to the person whose name and e-mail address appears on the entry form. Sponsor, its advertising and promotion agencies and the contest judges are not responsible for the distribution of a prize between any persons who may have participated.

MONTHLY PRIZE WINNER SELECTION PROCESS:

On December 1, 2009; January 4 , 2010; February 1 2010 March 1, 2010, April 1, 2010, the judges will conduct a random draw at 2:00:00 ET, at 1800 Laval Autoroute, Laval, Quebec H7S 2E7 (Maille Canada). Odds of winning depend on the number of eligible entries received. Unselected entries will be eligible for the subsequent monthly draws. Selected entrant will be contacted by telephone and then by mail. He/she must correctly answer a time-limited mathematical question and return a signed Declaration and Release form within fourteen (14) days of receiving the notification or prize will be forfeited and an alternate winner may be selected. The return of any prize/prize notification as undeliverable may result in disqualification and an alternate potential winner will be selected.

On April 1, 2010, the judges will conduct a random draw at 2:00:00 ET, at 1800 Laval Autoroute, Laval, Quebec H7S 2E7 (Maille Canada). Odds of winning depend on the number of eligible entries received. Selected entrant will be contacted by telephone and then by mail. He/she must correctly answer a time-limited mathematical question and return a signed Declaration and Release form within fourteen (14) days of receiving the notification or prize will be forfeited and an alternate winner may be selected. The return of any prize/prize notification as undeliverable may result in disqualification and an alternate potential winner will be selected.

GENERAL CONDITIONS:

By entering the Contest, each entrant agrees to the use of their name, address, voice, statements about the contest and/or picture or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.
Without limitation, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any failure of the Web site during the Contest; for any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Sponsor, its advertising and promotion agencies or the contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any Web site; or any combination of the above. Further, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any injury or damage to an entrant’s or any other person’s computer or data contained therein, related to or resulting from participating or downloading any material in the Contest.

The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”), to withdraw or amend this Contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules. Any attempt to deliberately damage any Web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.

This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the contest judges with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries.

In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an e-mail address by an Internet provider, online service provider, or other organization (e.g., business, educational institute, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If the identity of an online entrant is disputed, the authorized account holder associated with the e-mail account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The sole determinant of the time for the purposes of a valid online entry in this Contest will be the contest server machine(s).

The Sponsor, with the consent of the Régie, reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error or any kind.

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s Privacy Policy (available at www.mailleideas.ca), unless the entrant otherwise agrees.
